TERMS OF SERVICE

• Age Requirement: You must be at least 13 years of age to use VHS SCOUT. By creating an account, you represent and warrant that you meet this age requirement.
• Account Registration: To use the Software, you must register an account using your email address, which serves as your unique username.
• Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at rlstechnologiesmain@gmail.com of any unauthorized use of your account.

• Subscription or Usage Fees: Access to certain features of VHS SCOUT may require payment of a one-time lifetime fee.
• Third-Party Billing: All payment processing is handled securely by our third-party payment gateway, Stripe. We do not collect, process, or store your financial or credit card information.
• Payment Terms: By purchasing services through VHS SCOUT, you agree to Stripe's terms of service and authorize them to charge your chosen payment method for all applicable fees and taxes.
• No Refunds for Disruption: All fees are non-refundable. We do not offer refunds, credits, or prorated adjustments for any partial subscription periods, self-cancellations, system outages, integration failures, or unexpected service terminations.
• Lifetime Access Tied to Email Address: Your one-time lifetime Pro purchase is permanently and exclusively tied to the email address used at the time of purchase. This license is non-transferable and cannot be moved, reassigned, or applied to any other email address or account under any circumstances. If you lose access to your registered email address, are unable to recover it, or your email account is closed or suspended, your VHS SCOUT Pro access cannot be recovered or transferred. In such cases, you must create a new account using a new email address. A new purchase will be required to regain Pro access on the new account. RLS Technologies, LLC assumes no responsibility for loss of account access, Pro status, database records, collection data, scan history, or any other stored information resulting from loss of access to your registered email address.

• Your Content: The Software allows you to take, upload, and process images using your device's camera, photo gallery, or local file storage. You retain ownership of any images you upload ("User Content").
• Infrastructure Storage: Any User Content you upload is transferred to and stored permanently on servers managed by our third-party infrastructure platform, Base44 AI.
• Content Restrictions: You are solely responsible for your User Content. You strictly agree not to upload, store, or transmit any images or materials that:
  • Are illegal, fraudulent, harmful, or offensive.
  • Violate or infringe upon the intellectual property, copyright, trademark, or privacy rights of any third party.
  • Contain malware, viruses, or destructive computer code.
• Right to Remove: We reserve the right, but assume no obligation, to pre-screen, monitor, or permanently delete any User Content that we determine, in our sole discretion, violates these Terms.

• Our Property: Except for your User Content, all right, title, and interest in and to VHS SCOUT, including its software code, design, interfaces, logos, and AI-generated outputs, are and will remain the exclusive property of RLS Technologies, LLC and its licensors.
• Limited License: We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Software solely for your personal or internal business purposes in accordance with these Terms.

• Base44 AI Backend: VHS SCOUT is built utilizing the Base44 AI platform. Your data, integration tokens, and User Content are processed through Base44 infrastructure. You acknowledge that our ability to provide the Software relies entirely on our ongoing account status with Base44 AI.
• AI Accuracy Disclaimer: Results are AI-generated and may be inaccurate. VHS Scout is not responsible for purchasing decisions. RLS Technologies, LLC makes no guarantees regarding the accuracy, completeness, or reliability of any AI-driven outputs, insights, or data points provided by the Software. You use and rely on these AI-generated results strictly at your own financial and personal risk.

• Termination by You: You may terminate your account and stop using the Software at any time. You can request the permanent deletion of your account and your stored images by emailing rlstechnologiesmain@gmail.com.
• Termination by Us for Cause: We reserve the right to suspend or terminate your account and block your access to VHS SCOUT immediately, without prior notice or liability, if you violate any provision of these Terms.
• Right to Discontinue (Sunset Clause): We reserve the absolute right to modify, temporarily suspend, or permanently discontinue the Software, or any portion thereof, at any time, for any reason, or for no reason at all, including but not limited to economic unfeasibility, lack of profitability, or our own backend infrastructure subscription changes. Where reasonably practical, we will attempt to provide users with notice prior to a permanent shutdown, but we are under no legal obligation to do so and will not be liable to you or any third party for any closure of the service.

• General Disclaimer: VHS SCOUT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RLS TECHNOLOGIES, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR HACKING.
• Service Availability & Integration Tokens: We do not guarantee uninterrupted service. Downtime may occur due to third-party providers, routine system maintenance, software updates, emergency technical repairs, or unexpected technical/billing deactivations of our backend infrastructure and api integration tokens. You acknowledge that backend connection failures or token suspensions may occur without warning and cause temporary or total application lockout.

• Exclusion of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RLS TECHNOLOGIES, LLC, ITS DIRECTORS, EMPLOYEES, OR THIRD-PARTY INFRASTRUCTURE PROVIDERS (INCLUDING BASE44 AI AND STRIPE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, RECORDINGS, OR IMAGES, ARISING OUT OF OR CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• Liability Cap: IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF RLS TECHNOLOGIES, LLC TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SOFTWARE EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO RLS TECHNOLOGIES, LLC FOR THE ACCESS TO THE SOFTWARE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law principles.

RLS Technologies, LLC shall not be held liable or responsible for any failure, delay, or interruption in the performance of VHS SCOUT resulting from acts or events beyond our reasonable control. This includes, but is not limited to: platform outages or account suspensions of third-party infrastructure providers (such as Base44 AI or Stripe), server failures, integration token errors, cyberattacks, network routing disturbances, acts of God, war, government restrictions, or natural disasters.
